For example, for a Private Limited Company, the MCA filing fee is based on the authorized capital — typically ₹1,000–₹3,000 for ₹1 lakh authorized capital. These are separate from our professional fee and clearly disclosed upfront.

After incorporation, a Private Limited Company must fulfill: Annual Compliance: File AOC-4 (financial statements) and MGT-7/7A (annual return) with MCA every year. Income Tax: File ITR-6 before the due date. GST: Register if turnover exceeds ₹20L (₹10L for special category states) and file monthly/quarterly returns. Audit: Mandatory statutory audit every year. 🏢 Business Setup Can I register a company from home / with a home address?+

Yes! You can use your home address as the registered office of your company. You need to provide a utility bill (electricity/water bill) of the property and a No Objection Certificate (NOC) from the owner. Virtual offices come with a registered address, mail handling, and meeting room access.

🏢 Business Setup What is the minimum capital requirement for a Private Limited Company?+

There is no minimum paid-up capital requirement for a Private Limited Company since the Companies (Amendment) Act, 2015 removed the earlier ₹1 lakh minimum. You can incorporate with even ₹1 as paid-up capital. However, the authorized capital (stated in the MOA) attracts MCA fees based on slabs. Most startups start with ₹1 lakh authorized capital.

💰 Taxation When is GST registration mandatory?+

GST registration is mandatory when: (1) Your aggregate annual turnover exceeds ₹20 lakhs for service providers (₹10 lakhs in special category states). (2) Annual turnover exceeds ₹40 lakhs for goods suppliers (₹20 lakhs in special category states). (3) You supply goods or services across state borders (inter-state supply), regardless of turnover. (4) You are an e-commerce operator or sell via platforms like Amazon, Flipkart, etc. (5) You are a casual taxable person or non-resident taxable person. Voluntary registration is also possible even below the threshold.

💰 Taxation What is the due date for filing GST returns?+

Monthly Filers (QRMP opted out): GSTR-1 by 11th of following month; GSTR-3B by 20th of following month. Quarterly Filers (QRMP Scheme — turnover up to ₹5Cr): GSTR-1 (IFF) by 13th of month following quarter; GSTR-3B by 22nd/24th of month following quarter (staggered by state). GSTR-9 Annual Return: By 31st December of the following financial year. Late filing attracts ₹50/day penalty (₹20/day for NIL returns) capped at 0.04% of turnover.

💰 Taxation Which ITR form should I file?+

The right ITR form depends on your income source: ITR-1 (Sahaj): Salaried individuals with income up to ₹50L. ITR-2: Individuals/HUFs with capital gains, foreign income, more than one house property. ITR-3: Individuals/HUFs with business or professional income (with books of accounts). ITR-4 (Sugam): Presumptive income under Sec 44AD/44ADA/44AE (turnover up to ₹2Cr). 💰 Taxation What happens if I miss the ITR filing deadline?+

Missing the original ITR deadline has these consequences: (1) Late Filing Fee under Sec 234F: ₹5,000 (₹1,000 if total income is below ₹5L). (2) Interest under Sec 234A: 1% per month on tax due. (3) Loss of the right to carry forward certain losses (business losses, capital losses) to future years. (4) For companies, late filing may also attract MCA penalties. You can still file a Belated Return up to 31st December of the assessment year. If you missed that too, file an Updated Return (ITR-U) within 2 years of the end of the relevant assessment year with additional tax payment.

For most individuals: Form 16 (from employer for salary), Form 26AS / AIS / TIS (tax credit statement from IT portal — download free), bank statements, investment proofs (Section 80C, 80D, home loan interest certificate — Sec 24), capital gains statement from broker, rental income details, and Aadhaar/PAN linkage confirmation. For businesses and companies: audited financial statements, books of accounts, GST returns reconciliation, and TDS certificates are additionally required. ™️ IP & Legal How long does trademark registration take in India?+

The trademark registration process in India typically takes 18–24 months for a clean application without objections. Here's the timeline: TM Search & Filing: 2–5 days. Application Acceptance: 1–3 months (TM Registry processing). Trademark Journal Publication: Published in the Official TM Journal — 4 months opposition period. Registration Certificate: Issued if no opposition is filed — typically 6–12 months after journal publication. However, your mark is protected from the date of application and you can use the ™ symbol immediately after filing. The ® symbol can only be used after registration.

™️ IP & Legal What is the government fee for trademark registration?+

The official Trademark Registry government fee is: Individuals / Startups / MSMEs / Artists / Authors: ₹4,500 per class (concessional rate). Companies & LLPs: ₹9,500 per class. A trademark can cover multiple classes — each class represents a specific category of goods/services (there are 45 classes in total). If you sell clothing and also provide online retail services, you may need 2 separate classes. Our professional fee is charged in addition to the government fee. ™️ IP & Legal What happens if my trademark application is objected?+

A Trademark Objection (Section 9 or Section 11) is raised by the Examining Officer when the mark is found to be descriptive, similar to existing marks, or otherwise objectionable. You have 30 days from the date of the examination report to file a response (Reply to Examination Report). If the response is not satisfactory, a hearing is scheduled. We handle TM objection replies and hearing representations, crafting strong legal arguments based on distinctiveness, prior use, and market differentiation. Objection does not mean rejection — most objections are successfully resolved with a well-drafted reply.
